User agreement for the processing of personal data
1. General Provisions
1.1. This Policy regarding the processing of personal data (hereinafter - the Privacy Policy) applies to all information that the official website of the EL MAGIA online store (hereinafter - EL MAGIA) located on the domain name elmagia.cinar-studio.ru can receive information about the User during the use of the EL MAGIA website, as well as in subsequent relations with EL MAGIA, such as: providing feedback to the EL MAGIA Administration, filling out an application for detailed information about the goods.
1.2. The privacy policy in EL MAGIA was created in accordance with the Constitution of the Russian Federation, Federal Law of July 27, 2006 No. 152-ФЗ On Personal Data, and other legislative and other regulatory legal acts of the Russian Federation in the field of personal data.
1.3. This Privacy Policy is designed to implement the requirements of the legislation of the Russian Federation in the field of personal data processing, aimed at ensuring the protection of the rights and freedoms of man and citizen in the processing of his personal data, including protecting the right to privacy, personal and family secrets, in particular, in order to protect against unauthorized access to the User’s personal data.

2. Definition of terms

2.1.2. “Personal data” - any information, related directly or indirectly to a specific or determinable person (subject of personal data).
2.1.3. “Processing personal data” - any action (operation) or a set of actions (operations) performed using automation tools or without using such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
2.1.4. “Confidentiality of personal data” - a requirement for the operator or other person who has gained access to personal data to comply with the requirement not to allow their dissemination without the consent of the subject of personal data or the presence of another legal basis.
2.1.5. “EL MAGIA Website User (hereinafter referred to as the User)” is a person who has access to the EL MAGIA website through the Internet and uses the EL MAGIA website to clarify detailed information about products, and also uses the website to provide feedback to the EL MAGIA Administration and provide other services to the user.
2.1.6. “Cookies” - a small piece of data sent by the web server and stored on the user's computer, which the web client or web browser sends to the web server each time in an HTTPS request when trying to open the page of the corresponding site.
2.1.7. "IP address" - a unique network address of a node in a computer network built over IP.
3. General provisions
3.1. The receipt of services by the User through the EL MAGIA Website means acceptance of this Privacy Policy and the conditions for processing the User’s personal data.
3.2. This Privacy Policy applies only to the EL MAGIA site. The site administration is not responsible for third-party sites to which the User can get by click on the links available on the EL MAGIA site, as well as for third-party sites.
4. Subject of privacy policy
4.1. This Privacy Policy establishes the obligations of the EL MAGIA Site Administration to not disclose and ensure the regime for protecting the confidentiality of personal data, which the User provides at the request of the Site Administration when placing an application for detailed information about the goods.
4.2. Personal data authorized for processing under this Privacy Policy is provided by the User by filling out registration forms on the EL MAGIA website and includes the following information:
4.2.1. the name of the User or the person in whose interests the User acts;
4.2.2. contact telephone number of the User or the person in whose interests the User acts;
4.2.3. email address (e-mail);
4.3. The EL MAGIA website also protects Data that is automatically transmitted when viewing ad units and when visiting pages on which the system’s statistical script is installed (“pixel”):
- IP address;
- information from cookies;
- information about the browser (or other program that provides access to the display of advertising);
- access time;
- address of the page on which the ad unit is located;

4.3.1. Disabling cookies may result in the inability to access parts of the EL MAGIA website that require authorization.
4.3.2. The EL MAGIA website collects statistics about the IP addresses of its visitors. This information is used to identify and solve technical problems, to control the legality of financial payments.
4.4. Any other personal information not specified above (booking history, used browsers and operating systems, etc.) is subject to reliable storage and non-distribution, except as provided in paragraphs. 6.2. and 6.3. of this privacy policy.
5. Purpose of collecting user personal information
5.1. The Administration of the EL MAGIA website may use the User’s personal data in order to:

6. Methods and terms for processing personal information
6.1. The processing of the User’s personal data is carried out without any time limit, by any legal means, including in personal data information systems using automation tools or without using such tools.
6.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular, courier services, postal organizations, telecommunication operators solely for the purpose of fulfilling the User’s order placed on the EL MAGIA website.
6.3. The User’s personal data may be transferred to authorized bodies of state power of the Russian Federation only on the grounds and in the manner established by the legislation of the Russian Federation.
6.4. In case of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data.
6.5. The site administration takes the necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other illegal actions of third parties.

6.7. The User agrees to take all necessary measures to protect his personal data, to prevent their transfer to third parties, and to use without the consent of the User.
7. Obligations of the parties
7.1. The user must:
7.1.1. Provide personal information necessary to use the EL MAGIA website.
7.2. The site administration is obliged:
7.2.1. Use the information received solely for the purposes specified in paragraph 5 of this Privacy Policy.
7.2.2. Ensure the storage of confidential information in secret, not to disclose without the prior written permission of the User, and also not to sell, exchange, publish, or disclose in other possible ways the transmitted personal data of the User, with the exception of clauses 6.2. and 6.3. of this Privacy Policy.
7.2.3. Take precautions to protect the confidentiality of the User’s personal data in according to the procedure usually used to protect this kind of information in existing business transactions.
7.2.4. To block personal data related to the relevant User from the moment of contacting or requesting the User or his legal representative, or the authorized body to protect the rights of personal data subjects for the period of verification, in case of revealing inaccurate personal data or illegal actions.
8. Responsibility of the parties
8.1. The site administration, which has not fulfilled its obligations, is liable for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Russian Federation, with the exception of cases provided for in paragraph. 6.2., 6.3. and 8.2. of this Privacy Policy.
8.2. In case of loss or disclosure of Confidential Information, the Site Administration is not responsible if this confidential information:
8.2.1. Became public before its loss or disclosure.
8.2.2. Was received from a third party until it was received by the Site Administration.
8.2.3. Was disclosed with the consent of the User or due to the failure of the User to take due care to protect and store personal information.
8.2.4. It was disclosed due to the actions of third parties unrelated to the Site Administration.
9. Personal data of third parties provided by the User
9.1. Using the Site, the User has the right to enter personal data of third parties for subsequent use, including data of persons who are the ultimate recipients of EL MAGIA services and minors.
9.3. EL MAGIA has right to take the necessary measures to ensure the safety of personal data of third parties provided by the User.
10. Dispute Resolution
10.1. Before applying to the court with a claim for disputes arising from the relationship between the User and the Site Administration, a claim (a written proposal for the voluntary settlement of the dispute) is mandatory.
10.2. The term for consideration of a claim is 10 (ten) calendar days.
10.3. If an agreement is not reached, the dispute will be referred to the judicial authority in accordance with the current legislation of the Russian Federation.
10.4. The current legislation of the Russian Federation applies to this Privacy Policy and the relationship between the User and the Site Administration.
11. Additional terms
11.1. The site administration has the right to make changes to this Privacy Policy without the consent of the User.
11.2. The new Privacy Policy comes into force from the moment it is posted on the EL MAGIA Website, unless otherwise provided by the new version of the Privacy Policy.
11.3. All suggestions or questions about this Privacy Policy should be reported through feedback on the EL MAGIA website.
